Focus: In response to the evolving landscape of Title IX regulations, institutions are presented with newfound flexibility in designing procedures for addressing allegations of sexual harassment within their programs and activities. This training is designed to provide a fresh perspective on this flexibility, empowering institutions to create procedures that are not only compliant but tailored to their unique needs. Join us for two dynamic sessions that delve into key concepts, ensuring participants are well-versed in the latest Department of Education guidance. These sessions satisfy the requirements for training under Title IX and the Violence Against Women Act.

1:30pm to 2:45pm – Session 1: Designing Your Grievance Procedure to Comply with the New Title IX Regulations
The Department of Education’s new Title IX regulations provide colleges and universities with significant flexibility in how they design their procedures for addressing allegations that sexual harassment has occurred in their institution’s programs and activities. As a result, institutions have an opportunity to align their Title IX procedures with their broader priorities and available resources. This session will review key changes between the 2020 regulations and the soon-to-be-released 2024 regulations, what institutions need to know when they start revising their Title IX procedures in light of the new regulations, and how institutions might balance competing priorities related to their Title IX procedures.

3:00pm to 4:00pm – Session 2: Key Topics for Title IX Coordinators, Investigators, and Decision makers
Both the 2020 and 2024 Title IX regulations require institutions to provide training on a host of topics to everyone involved in an institution’s Title IX grievance process, including Title IX coordinators themselves, anyone involved in investigating allegations of sexual harassment, and those individuals whom an institution has put in charge of deciding whether or not allegations of sexual harassment have been proven. This session is designed to satisfy this training requirement by explaining key concepts such as how to serve impartially, avoiding prejudgment and conflicts of interest, the relevant standard of proof, prohibitions against pregnancy-related discrimination, equitable treatment of complainants and respondents, supportive measures, sanctioning decisions, and requirements related to the appeal process.
