Data Breach
- Coordinating breach notification responses and assisting companies with forensic support.
- Counseling companies, officers, and boards of directors on developing and implementing risk and crisis management strategies.
- Liaising with government and state law enforcement.
- Proactive protection counseling and planning.
Compliance
- Training and advising clients regarding compliance with international, federal, state, and local laws and regulations governing data security.
- Facilitating network security, privacy and cybersecurity compliance audits.
- Counseling on data compliance strategies and the development of proactive data protection programs.
Transactional Support And Contract Review
- Guiding clients on cybersecurity risks that may be underlying in a potential transaction.
- Performing cybersecurity-specific due diligence to assess and address risk in the context of mergers and acquisitions, private equity transactions and other corporate transactions.
- Reviewing and negotiating contracts concerning data and vendor relationships, reviewing investment disclosures and analyzing risks inherent in the investment in and use of data.
Litigation
- Defending companies in government and regulatory investigations.
- Defending companies in class action and other litigation resulting from data breaches.
- Enforcing actions against third parties liable under contract or other standard of care.
