Zachary J. Daly

Zach is an associate in the firm’s Intellectual Property Practice Group and is a registered patent attorney. He dedicates his practice to the preparation and prosecution of patents, copyrights and trademarks. 

As part of his patent preparation and prosecution practice, Zach asserts patent rights against willful infringers, conducts patent due diligence and helps develop robust IP portfolios. In his copyright practice, he addresses ownership and licensing issues, handles infringement cases, and advises clients on fair use and compliance. Additionally, he assists clients with trademark enforcement by identifying and addressing potential infringements to ensure the protection of their brand identities in the marketplace.

Zach provides litigation support in intellectual property matters and offers strategic guidance to clients on protecting their IP rights across diverse industries. He has experience working with clients ranging from small startups to large corporations. With a background in physics, Zach has provided services to clients in fields such as mechanical, electrical, medical, and systems technologies.

Zach is dedicated to understanding each client’s unique needs and establishing a clear plan that aligns with their goals. By setting realistic expectations for outcomes and deadlines, he ensures clients are fully informed throughout the process with transparency as a priority. Zach also prioritizes continuous growth and adaptation in the legal field to provide the highest level of service.

Zach earned his degree in physics from Elizabethtown College before attending Santa Clara University School of Law. In his spare time, Zach enjoys hiking, snowboarding and collecting vinyl records.

Susanna M. Fultz

Susanna is a member of the firm’s Employment and Litigation practice groups with more than a decade of experience. She exclusively devotes her practice to employment law matters. Susanna works closely with employers, providing solutions to a myriad of employment issues while helping them to mitigate risk. 

As an employment law counselor, Susanna advises clients on matters relating to the American with Disabilities Act, Fair Labor Standards Act, performance and conduct related issues, workplace harassment investigations, state and federal discrimination regulations and more. She helps employers manage their internal operations to ensure best practices in accordance with state and federal employment laws and regulations. For example, Susanna regularly drafts documents such as handbooks and employee policies.

In her employment litigation practice, Susanna represents employers on matters ranging from non-compete agreements, separation and severance agreements, employment contracts and discrimination matters. She has experience practicing before state and federal court, the Pennsylvania Human Relations Commission and the Equal Employment Opportunity Commission. 

Susanna takes pride in offering ethical and effective legal counsel to achieve the best outcomes for her clients. She is also responsive to client inquiries, ensuring timely communication and exceptional service throughout the process. In addition to counseling employers, Susanna is involved with the Berks County Bar Association as chair of its employment law section. She frequently presents on a variety of employment law matters such as wage and hour issues and workplace harassment investigations.

Susanna is a graduate of the University of Delaware and Washington & Lee University School of Law. While in law school, Susanna interned at the United Nations in Vienna, Austria, and participated in several international clinics in Europe and Asia. After graduating from law school, Susanna served as a judicial law clerk to the Hon. A. Joseph Antanavage and then to the Hon. James M. Lillis in the Berks County Court of Common Pleas. She joined private practice in 2018. Susanna and her husband reside in Reading. She enjoys sports and hiking and loves to travel.

Zachary D. Griffith

Zach is a member of the firm’s Trusts & Estates Practice Group. He focuses his practice in the areas of estate planning, estate administration, trust formation, and guardianships. With a client-driven approach, Zach prioritizes building strong relationships and understanding the unique needs of each individual. He believes that effective estate planning is not one-size-fits-all but requires a tailored strategy that reflects each client’s specific situation and goals. Approachable and pragmatic, Zach is committed to providing exceptional legal services that empower clients to achieve peace of mind regarding their estate planning and administration needs.

In his estate planning practice, Zach assists clients in creating comprehensive estate plans, including drafting wills, revocable and irrevocable trusts, financial power of attorney documents, healthcare power of attorney documents, and living wills. In his estate administration practice, Zach provides compassionate guidance during challenging times and helps clients navigate the complexities of probate, marshalling assets, evaluating and settling debts, resolving beneficiary disputes, and ensuring final distributions are made in a timely and efficient manner.

Additionally, Zach handles the intricacies of guardianship matters which includes filing initial petitions, assisting with annual filing requirements, and filing petitions seeking court approval for expenditures of principal and real property sales. He is also well-versed in Orphans’ Court litigation, representing clients through all stages of disputes and effectively protecting their interests. 

Zach joined Barley Snyder after a distinguished academic career, graduating magna cum laude from Widener University Delaware Law School and summa cum laude from Albright College. During law school, Zach interned at Information Systems Laboratories and EnerSys, gaining valuable experience in the technology sector. Zach also holds a Master of Laws in Taxation from Villanova University. With this knowledge, Zach provides counsel relating to personal income tax issues in addition to various aspects of taxes related to trusts and estates. 

Outside of the firm, Zach is the Vice President of Court Appointed Special Advocates (CASA) of Berks County’s board of directors. He also serves as chair of the governance committee where he assists in furthering CASA’s mission to positively change the lives of children who face neglect, abuse, and/or abandonment.

In his spare time, he is a volunteer tour guide at the Reading-area Mid-Atlantic Air Museum, one of the largest privately owned aviation museums in the country. He also enjoys spending time with his wife, daughter, two dogs, and his family.

Caleb P. Setlock

Caleb is an attorney concentrating his practice on employment law, labor law and litigation. He regularly represents employers in litigation and advises them on best-practice methods. His common areas of focus include:

Employment Counseling
Caleb works closely with employers to address day-to-day workplace challenges, offering practical solutions on issues such as employee misconduct, terminations, severance agreements, restrictive covenant agreements, investigations, wage and hour compliance, disability accommodations, FMLA adherence, policy review, unemployment appeals, and more. He also provides guidance on the implications of legal updates and new employment laws.

Employment Litigation
Caleb is an active litigator defending employers against charges of race, sex, religion, age, and disability discrimination and harassment, as well as defending employers against wage and payment claims. He defends claims against companies brought under Title VII, ADA,ADEA, FMLA, FLSA, 42 U.S.C. § 1981, PHRA, PMWA, PFEOA, APSA, OAPSA, Pennsylvania common law, civil torts like assault and battery, and more. He also represents companies in trade secret and restrictive covenant litigation, helping employers protect their business interests and confidential information. 

Through his years of employment litigation experience, Caleb has successfully received motions to dismiss, motions for summary judgment, final judgments from the Middle and Eastern District Court of Pennsylvania, final judgments from the Pennsylvania Commonwealth Court, and more. 

Government Investigations
Caleb represents employers in audits and investigations brought by governmental agencies. He has successfully defended companies in actions brought by the EEOC, PHRC, HUD, USDA, Pennsylvania DOL, U.S. DOL, Pennsylvania DHS, PLRB and OSHA.

Other Litigation
While Caleb’s practice primarily focuses on employer-employee compliance, he also litigates general business claims. In this role, he serves as both plaintiff and defense counsel to advocate for businesses’ rights. 

A Lancaster County native, Caleb grew up in Lititz before returning to the area after law school. He is proud to continue a firm tradition of former Barley Snyder summer associates joining the firm. Outside of work, Caleb enjoys an active lifestyle, participating in various recreational sports with his wife in Mount Joy.

Michael W. Fox

Mike is an attorney in the firm’s Business and Real Estate practice groups with nearly a decade of experience. He is a transactional attorney with a varied and wide-ranging practice focused in the areas of business, mergers and acquisitions, real estate, and finance.

A significant part of Mike’s practice is guiding clients through the often-complex process of mergers and acquisitions. As an M&A advisor, he conducts due diligence, structures transactions, negotiates and drafts letters of intent, negotiates and drafts acquisition agreements, assists with the coordination of financing sources, and brings a transaction to a successful close. Mike has worked on behalf of buyers and sellers in transactions ranging in value from $200,000 to over $250 million.  Mike also assists clients with a variety of general business matters including entity selection and formation, contract drafting and review, lease negotiation and review, corporate governance and more. 

In his real estate practice, Mike helps clients with commercial real estate transactions, real estate development and financing, and real estate title matters. Early in his career, Mike developed a strong foundation in the areas of real estate development, land use planning, real estate title matters, and business entity formation.  Mike represents buyers and sellers of commercial real estate from letter of intent/agreement of sale stage through closing and development, and also regularly represents landlords and tenants in commercial lease drafting and negotiation. As a member of the firm’s Construction Industry Group, Mike also represents construction contractors, subcontractors, and owners in the review and drafting of construction contracts, and advising on issues in the construction process as they arise in this inherently complex field.

In his finance practice, Mike has experience working with banks and private lenders to document commercial loan transactions, and he also negotiates loan documents on behalf of borrowers.  

A Lebanon County native, Mike is based in the firm’s Schuylkill Haven office and works frequently with clients throughout central Pennsylvania, including Schuylkill, Lancaster, Lebanon, Harrisburg, York, Reading and beyond. His clients range from individuals to small and large businesses, and he often works with clients in the construction and manufacturing industries 

Mike is active in the communities in which he works and lives. Mike currently sits on the board of directors for the Schuylkill Economic Development Corporation and the Mauch Chunk Trust Company Community Advisory Board. He also serves as a co-facilitator of a Berks County Key Executive Peer Group for The S. Dale High Center for Family Business. Mike is the son of two public school music teachers. He resides in Lebanon with his wife, Irene, two daughters, Margot and Lillian, and son, Benjamin.

John M. Quain, Jr.

J. is an experienced attorney in Barley Snyder’s Litigation Practice Group, focusing on litigation, appellate matters and regulatory compliance. He believes that achieving favorable results requires thinking outside the box. Creativity, ingenuity and attention to detail are key to finding the best path forward. J. prides himself on being attentive, communicative, and focused on finding thoughtful, alternative solutions to reach clients’ desired outcomes. 

Litigation
J. assists clients with a diverse range of litigation matters, including breach of contract, real estate disputes, landlord-tenant issues, fiduciary matters and more. He is also a member of the firm’s Finance Creditors’ Rights Practice Group, where he handles bankruptcy and debt collection. J. has worked with contractors and corporate companies on their collection efforts and has defended his clients’ priority of mortgages and liens. He has also asserted the property rights of clients following a change of ownership in real property.  

Previously, J. was the lead litigator at the Pennsylvania Department of Community and Economic Development (DCED), where he successfully recovered over $15 million in taxpayer dollars through judgments, bankruptcy proceedings and settlement agreements. He also provided counsel during the City of Harrisburg’s financial recovery efforts, representing the DCED throughout the process.

Appellate
J. has extensive appellate experience, having secured victories on appeals in the Commonwealth Court, Superior Court and Supreme Court of Pennsylvania. His in-depth understanding of appellate procedure enables him to guide clients through every stage of the appellate process – from initial filings to post-decision motions. His background in handling administrative appeals and government proceedings adds to his proficiency in navigating complex appeals through administrative agencies and, when necessary, up through the courts.

Regulatory Compliance
J. provides business advisory services for state-issued licensure issues, advising clients on regulatory compliance and guiding them through the administrative process and appeals up through the courts when required.

Prior to his experience in Pennsylvania, J. served as a law clerk to the Hon. Michael J. Kassel in the New Jersey Superior Court. A Harrisburg native, J. is very active in the Dauphin County community and currently lives in Lancaster with his family. Outside of the firm, J. chairs the Dauphin County Bar Association’s Young Lawyers Section.

J. prevailed before the Pennsylvania Supreme Court appealing a trial court’s decision that satisfied our client’s $1.6 million judgment based on a Petition for Declaratory Judgment filed by the judgment debtor after the trial court had already upheld the judgment in two prior actions challenging the judgment. The Superior Court affirmed on the basis of the trial court’s opinion. J. filed a Petition to have the Pennsylvania Supreme Court review the lower court decision, which the Supreme Court only grants in about 6% of cases. J. argued that the lower court decisions would make all Pennsylvania judgments lack finality because a judgment debtor court strike the judgment by ignoring procedure and requiring the judgment creditor to relitigate the already decided case.  The Supreme Court agreed and vacated the lower court decision without requiring any briefing on the issue.

J. represented a large childcare provider that had a license to operate revoked following a single violation of the Human Services Code. The Department of Human Services revoked the facility’s license to operate without proper notice and without considering the provider’s long record of historical compliance. After the Department refused to reconsider its action, J. appealed the decision to the Commonwealth Court, arguing that the provider’s record of service and the Department’s failure to consider the lack of serious prior violations entitled it to a provisional license as a matter of law. After the hearing argument, the Commonwealth Court agreed and reversed the Department of Human Service’s revocation of the facility’s license, enabling the provider to continue to serve the community with an unblemished record.

J. represented a beneficiary of a trust that sold a large tract of land worth over $1.6 million.  After initially opposing the sale, the beneficiary agreed to consent to the sale under certain terms guarantying the beneficiary certain distributions in accordance with the trust, which was entered as an Order of Court.  In negotiating the sale, the trustees discovered that a portion of the property was not owned by the trust and proceeded with finalizing the sale without revealing the issue to the beneficiary, resulting in a substantial reduction in the beneficiary’s share of distributions.  J. brought a Petition for Contempt and to Enforce the Agreement wherein the beneficiary authorized the sale of the property.  After a bench trial, the Court ruled that the trustees had breached their fiduciary duties, enforced the terms of the agreement permitting the sale, and awarded compensatory damages and sanctions against the trustees for the breach of fiduciary duties.

Katelyn E. Rohrbaugh

Kate is a dedicated member of the firm’s Litigation, Real Estate, Hospitality and Liquor Law groups, in addition to being a licensed title agent. She brings extensive knowledge to her clients’ most complex legal challenges and takes the time to understand their needs, fostering strong, effective relationships.

Committed to achieving the best possible outcomes, Kate communicates clearly and works collaboratively, navigating the legal landscape with efficiency and integrity. A strong advocate for practical solutions, she ensures that her clients are well-informed about potential outcomes and resolution strategies from the outset. Kate regularly collaborates with a diverse group of clients, including restaurants, hotels, commercial retailers, brokers, property management companies, and non-profit organizations.

Litigation
Kate focuses her practice primarily on litigation matters, specifically in the areas of commercial litigation, fiduciary litigation, real estate litigation, appellate litigation and construction litigation. Commercial 
– Kate and team represented a railroad company in obtaining emergency injunctive relief against a landowner blocking the railroad company’s tracks. The railroad company had a right of way dating back to the 1800s when the railroad was first built. The landowner asserted multiple defenses including claims of abandonment and misuse. Ultimately, the York County Court of Common Pleas agreed that the railroad company had met the high burden of a preliminary injunction hearing and granted an order protecting the railroad’s continued use of the tracks.

– Kate successfully defended a multifamily housing developer in a bench trial in York County against a breach of contract and unjust enrichment claim brought by an architect who alleged our client failed to fulfill its contractual obligations. The architect’s claim could have exposed our client to over $150,000, including potential attorneys’ fees. Katelyn’s defense effectively dismissed all claims, securing a favorable verdict for her client and shielding them from both the alleged amount owed under the contract and the risk of attorney fee liability.

– Kate was successful in York County on a Motion for Judgment on the Pleadings wherein the client purchased a property which was subject to a reservation in a deed for the prior owner to continue receiving income from a Billboard Lease until the term ended. The prior owner tried to pull one over on the client by amending the Billboard Lease to allow for additional terms the year before the lease was set to end and the rights would be given back to our client. Ultimately, the Court agreed with our argument that the term in the lease was definite and the attempted new amended lease for an extended term was void. We were able to negotiate a lease with the prior renter for our client who will benefit over $150,000 from the lease.

Fiduciary
– Kate and her team successfully represented the beneficiary of a trust in a complex dispute before the Mifflin County Orphans’ Court. The case involved multiple challenges, including a $250,000 claim based on an alleged common law marriage, which the court rejected after trial. Kate also secured favorable rulings on several intricate trust interpretation issues, yielding the beneficiary $2.6 million. The outcome was affirmed on appeal by both the Pennsylvania Superior and Supreme Courts.

Real Estate 
– Kate and team represented a shopping center owner in Dauphin County that was subject to a complete condemnation by PennDOT. After receiving a low offer for the eminent domain of property, the Barley team worked with an appraiser and were able to obtain a $4.55 million payment for the shopping center owner.

– Kate and team represented a non-profit health system in a tax assessment appeal in the Cumberland County Court of Common Pleas relative to a large medical complex. Despite the health system acquiring the medical complex for $45 million, the Barley team negotiated with the taxing authorities for a settlement at a $31 million fair market value. This settlement resulted in over $160,000 per year in tax savings for the health system.

Real Estate
In her real estate practice, Kate covers a range of services, including commercial transactions, tax assessment appeals and exemptions, and commercial leasing. Her title agent license enhances her real estate work, offering a well-rounded perspective on each matter. 

Liquor Law
In the hospitality sector, Kate works closely with clients regarding their liquor law needs, assisting with licensing, renewals and enforcement matters. She thoroughly enjoys this niche area of her practice, guiding her clients through the complexities of liquor law.  

Outside of the office, Kate is highly active in her community, serving on various boards of local nonprofit organizations. The West York native enjoys hitting the gym, spending time with her family, and indulging in her passion for baking.

Erica R. Townes

Erica is an attorney in the Business and Real Estate practice groups. In her corporate practice, Erica represents businesses of all sizes and sophistication across a variety of industries. Erica’s practice ranges from assisting start-up companies with entity formation and governing documents to routinely working with more seasoned companies on complex mergers and acquisitions, strategic corporate restructuring, and succession planning. She frequently works with privately held, closely held, and family-owned businesses, providing tailored legal counsel to address their unique challenges, particularly in governance, succession planning, and strategic growth. Erica also devotes a substantial portion of her practice to assisting clients in residential and commercial development, property acquisition, commercial lease negotiations, zoning, and land use concerns. In both facets, Erica focuses on the structure, negotiation, and strategic planning of business and real estate transactions.

To complement her corporate law practice, Erica maintains an active nonprofit practice, advising tax-exempt organizations on formation, governance, and regulatory compliance. She serves on the board of and is involved with a number of local nonprofit and professional organizations, including the York County Bar Foundation Board of Directors, the Dauphin County Bar Association Young Lawyers Section, and the DreamWrights Center for Community Arts Board of Directors. 

Erica believes that effective legal representation requires a combination of strategic thinking, attention to detail, and a deep understanding of each client’s priorities. When not practicing law, Erica’s firm responsibilities include serving as a member of the firm’s Hiring Committee, where she is involved in recruiting for the firm’s Summer Associate Program. Prior to joining Barley Snyder, Erica externed for the Supreme Court of Pennsylvania and the Commonwealth Court of Pennsylvania for the Hon. P. Kevin Brobson as a law student.

While not a performer herself, Erica is a musical theatre enthusiast and frequently patronizes New York City and central Pennsylvania theatre productions. Her favorite show running on Broadway is “Hamilton.”

Eric M. Ondo

Eric is a member of the firm’s Business, Mergers & Acquisitions and Real Estate groups. 

In his business practice, Eric advises clients on all aspects of their business, ranging from entity selection and formation to succession planning. He counsels private entities — including closely held and family-owned businesses — on mergers, acquisitions, corporate governance and a variety of other transactional matters. He also frequently assists clients with general business issues including contract drafting, review and negotiation. Furthermore, Eric has experience with handling formations for nonprofit organizations. 

A substantial portion of Eric’s practice is assisting clients with mergers and acquisitions, including stock and asset transactions. In this role, he conducts due diligence, structures transactions, negotiates and drafts letters of intent, negotiates and drafts acquisition agreements, reviews non-compete and non-disclosure agreements in addition to other matters. Eric enjoys helping his clients navigate the complex process of M&A transactions, ultimately helping to bring the deal to a success close. 

Eric’s real estate practice dovetails with his business practice where he handles matters relating to residential and commercial agreements of sale, leases, restrictive covenants, easements as well as navigating various zoning and land-use issues.

Eric started at Barley Snyder as summer associate and continues a long-time tradition of joining the firm later as an attorney. During law school, Eric practiced as a certified legal intern at the Penn State Family Law Clinic, gaining valuable experience working directly with clients. He also donated pro bono services drafting trusts and estates documents for senior citizens in Centre County. In addition, Eric worked as an intern with the Pennsylvania Office of General Counsel, aiding the Pennsylvania Department of State’s Bureau of Professional and Occupational Affairs in 2018. Before moving into law, Eric worked in investment performance in the Washington, D.C. area. He also was a Congressional intern in the U.S. House of Representatives. His wide range of experiences have aided Eric in bringing a thoughtful, considered approach to the unique circumstances and goals of his clients.

A Lebanon County native, Eric now lives in Lancaster County and is a former Eagle Scout. He played four years of football at Dickinson College, where he graduated cum laude, and is also a cum laude graduate of Penn State Law. Eric is proud to be a member of Leadership Lancaster Core Class of 2024 and values community service and involvement. In his time away from the office, Eric enjoys spending time with his wife and son, golfing and Penn State football.

EmmaRose Strohl

EmmaRose is an integral part of the firm’s Food & Agribusiness Industry Group, working with clients on compliance issues with state and federal agencies such as the U.S. Food and Drug Administration, U.S. Department of Agriculture, and Pennsylvania Department of Agriculture. She helps clients remain up to date on pressing issues and regulatory developments, and advises clients on compliance and risk management. Additionally, she provides strategic counsel to clients on commercial and supply chain matters within the agricultural product, food processing, manufacturing and distribution sectors. EmmaRose also supports the complementing Transportation & Logistics industry, providing compliance and commercial guidance in another highly regulated sector. 

Her strong agricultural background has made her a logical fit for Barley Snyder’s Food & Agribusiness Industry Group. Before law school, EmmaRose graduated with a bachelor’s degree in Animal Science with a specialization in Livestock Science and Management from one of Pennsylvania’s highest-rated agricultural universities. She also volunteered for the Penn State Extension with local 4-H and extension programs, and continues to provide a helping hand to neighbors in the farming community when the need arises. Raised on a small farm in Schuylkill County surrounded by horses and honeybees, EmmaRose’s hands-on experience in agriculture adds a unique depth to her legal practice.

EmmaRose is dedicated to mentoring the next generation of professionals and passing down her knowledge. She helped launch the Master’s in Agribusiness program at Delaware Valley University and previously served as an adjunct professor, teaching graduate-level courses on “Legal Issues in Agriculture and Food” and “Agricultural Supply Chains.” EmmaRose currently mentors junior associates within the firm.

EmmaRose serves as outside general counsel to several clients in the high-value food products sector, providing strategic guidance to help them grow and thrive. She has also  successfully advocated on behalf of her clients before the various regulatory bodies, including the Pennsylvania and U.S. Departments of Agriculture, working to ensure the fair and equitable application of regulations and championing regulatory updates that better reflect today’s landscape of modern agriculture and food processing. In addition, EmmaRose has experience successfully representing clients in commercial livestock animal welfare litigation.

Another aspect of her practice is crafting comprehensive plans for clients’ and their businesses’ futures. EmmaRose provides tailored business succession planning, frequently for food and agriculture sector clients, ensuring the seamless transition of operations and the continued success of these unique enterprises across generations. She also provides services to local clients for general estate planning, including wills, powers of attorney, health care powers of attorney and living wills. 

Her business practice complements her food and agriculture work, where she handles general corporate matters such as LLC formation, operating agreements, contract negotiations, financing and stock transfers.

EmmaRose now lives on a small farm in Berks County with her husband and daughter, and enjoys whitewater kayaking, snowboarding, riding horses and dirt bikes and hiking with her dogs.
