Zachary J. Daly

Zach is an associate in the firm’s Intellectual Property Practice Group and is a registered patent attorney. He attended Elizabethtown College and graduated with a degree in physics before attending Santa Clara University School of Law.

Zach has experience with preparation and prosecution of copyrights and trademarks in addition to patent preparation and prosecution. He has experience and provides litigation support in areas involving intellectual property. He also provides guidance and strategy to clients for protecting their intellectual property rights in diverse industries. Zach has a wide range of client experience from dealing with small-startup businesses to large corporations. Zach possess a background in physics and has provided services to clients in a plurality of fields including mechanical, electrical, medical and systems.

In his spare time, Zach enjoys hiking, snowboarding and collecting vinyl records.

Susanna M. Fultz

Susanna is a member of the firm’s Employment and Litigation practice groups with more than a decade of experience. She works closely with employers, providing solutions to a myriad of employment issues while helping them to mitigate risk.

As an employment law counselor, Susanna advises clients on matters relating to the American with Disabilities Act, Fair Labor Standards Act, performance and conduct related issues, workplace harassment investigations, state and federal discrimination regulations and more. She helps employers manage their internal operations to ensure best practices in accordance with state and federal employment laws and regulations.

In her employment litigation practice, Susanna represents employers on matters ranging from non-compete agreements, separation and severance agreements, employment contracts and discrimination matters. She has experience practicing before state and federal court, the Pennsylvania Human Relations Commission and the Equal Employment Opportunity Commission.

In addition to counseling employers, Susanna is involved with the Berks County Bar Association as chair of its employment law section. She frequently presents on a variety of employment law matters such as wage and hour issues and workplace harassment investigations.

Susanna is a graduate of the University of Delaware and Washington & Lee University School of Law. While in law school, Susanna interned at the United Nations in Vienna, Austria, and participated in several international clinics in Europe and Asia. After graduating from law school, Susanna served as a judicial law clerk to the Hon. A. Joseph Antanavage and then to the Hon. James M. Lillis in the Berks County Court of Common Pleas. She joined private practice in 2018.

An active member of her community, Susanna serves on the board of directors of ReadingFilm. Susanna and her husband reside in Reading. She enjoys sports and hiking and loves to travel.

Zachary D. Griffith

Zach is a member of the firm’s Trusts & Estates Practice Group. He focuses his practice in the areas of estate planning, estate administration, trust formation, and guardianships. With a client-driven approach, Zach prioritizes building strong relationships and understanding the unique needs of each individual. He believes that effective estate planning is not one-size-fits-all but requires a tailored strategy that reflects each client’s specific situation and goals. Approachable and pragmatic, Zach is committed to providing exceptional legal services that empower clients to achieve peace of mind regarding their estate planning and administration needs.

In his estate planning practice, Zach assists clients in creating comprehensive estate plans, including drafting wills, revocable and irrevocable trusts, financial power of attorney documents, healthcare power of attorney documents, and living wills. In his estate administration practice, Zach provides compassionate guidance during challenging times and helps clients navigate the complexities of probate, marshalling assets, evaluating and settling debts, resolving beneficiary disputes, and ensuring final distributions are made in a timely and efficient manner.

Additionally, Zach handles the intricacies of guardianship matters which includes filing initial petitions, assisting with annual filing requirements, and filing petitions seeking court approval for expenditures of principal and real property sales. He is also well-versed in Orphans’ Court litigation, representing clients through all stages of disputes and effectively protecting their interests. 

Zach joined Barley Snyder after a distinguished academic career, graduating magna cum laude from Widener University Delaware Law School and summa cum laude from Albright College. During law school, Zach interned at Information Systems Laboratories and EnerSys, gaining valuable experience in the technology sector. Zach also holds a Master of Laws in Taxation from Villanova University. With this knowledge, Zach provides counsel relating to personal income tax issues in addition to various aspects of taxes related to trusts and estates. 

Outside of the firm, Zach is the Vice President of Court Appointed Special Advocates (CASA) of Berks County’s board of directors. He also serves as chair of the governance committee where he assists in furthering CASA’s mission to positively change the lives of children who face neglect, abuse, and/or abandonment.

In his spare time, he is a volunteer tour guide at the Reading-area Mid-Atlantic Air Museum, one of the largest privately owned aviation museums in the country. He also enjoys spending time with his wife, daughter, two dogs, and his family.

Caleb P. Setlock

Caleb is an attorney in the Employment and Labor Law Practices, representing employers in litigation and advising on best-practice methods.

Caleb has experience defending a wide variety of employee claims. His primary practice includes federal discrimination claims under Title VII, 42 U.S.C. § 1981, the ADA, the Rehabilitation Act of 1973, the ADEA, Title VIII and the Fair Housing Act, and state discrimination claims under the PHRA and the PFEOA. In defending against these claims, Caleb has dealt with race, sex, religion, age, and disability charges. Caleb also handles claims under the Fair Labor Standards Act and Pennsylvania’s Minimum Wage Act, and Wage Payment and Collection Law.

In handling these matters for clients, Caleb is involved at all stages of litigation, from pleadings at the U.S. Equal Employment Opportunity Commission or the Pennsylvania Human Relations Commission to federal and state court civil claims. Outside of litigation, Caleb has settled matters through mediation and conciliation attempts. Caleb also regularly represents employers through the unemployment compensation process. His experience in Labor Law consists of providing rapid response training to clients and defending against unfair labor practice charges.

In the hospitality sector, Caleb counsels clients on crafting niche employment policies specific to the industry including tip pooling arrangements. He navigates business through multi-state and multi-ordinance compliance. He also litigates in defense of employment claims that reach court or administrative agencies.

Caleb helps continue a longtime firm tradition of former Barley Snyder summer associates that later join the firm as full-time attorneys.

At the Duquesne University School of Law, where he graduated cum laude, Caleb was a member of the school’s appellate moot court board that won the Wagner National Labor and Employment Law Moot Court Competition. Caleb also was a mentor in the school’s Academic Excellence Program and worked in the school’s law library.

A Lancaster County native, Caleb is firmly committed to the greater Lancaster area. Growing up, he worked at Bent Creek Country Club and received the J. Wood Platt Caddie Scholarship. Prior to joining Barley Snyder, Caleb also worked as an intern with the Lancaster County Public Defender’s Office. He also operated a local landscaping business by himself for four years. 

In his time away from the office, Caleb enjoys physical exercise of any kind including running and biking. Caleb likes playing any and all recreational sports from individual sports like golf and tennis to team sports like soccer and basketball.

Michael W. Fox

Mike is an attorney in the firm’s Business and Real Estate practice groups with nearly a decade of experience. He is a transactional attorney with a varied and wide-ranging practice focused in the areas of business, mergers and acquisitions, real estate, and finance.

A significant part of Mike’s practice is guiding clients through the often-complex process of mergers and acquisitions. As an M&A advisor, he conducts due diligence, structures transactions, negotiates and drafts letters of intent, negotiates and drafts acquisition agreements, assists with the coordination of financing sources, and brings a transaction to a successful close. Mike has worked on behalf of buyers and sellers in transactions ranging in value from $200,000 to over $250 million.  Mike also assists clients with a variety of general business matters including entity selection and formation, contract drafting and review, lease negotiation and review, corporate governance and more. 

In his real estate practice, Mike helps clients with commercial real estate transactions, real estate development and financing, and real estate title matters. Early in his career, Mike developed a strong foundation in the areas of real estate development, land use planning, real estate title matters, and business entity formation.  Mike represents buyers and sellers of commercial real estate from letter of intent/agreement of sale stage through closing and development, and also regularly represents landlords and tenants in commercial lease drafting and negotiation. As a member of the firm’s Construction Industry Group, Mike also represents construction contractors, subcontractors, and owners in the review and drafting of construction contracts, and advising on issues in the construction process as they arise in this inherently complex field.

In his finance practice, Mike has experience working with banks and private lenders to document commercial loan transactions, and he also negotiates loan documents on behalf of borrowers.  

A Lebanon County native, Mike is based in the firm’s Schuylkill Haven office and works frequently with clients throughout central Pennsylvania, including Schuylkill, Lancaster, Lebanon, Harrisburg, York, Reading and beyond. His clients range from individuals to small and large businesses, and he often works with clients in the construction and manufacturing industries 

Mike is active in the communities in which he works and lives. Mike currently sits on the board of directors for the Schuylkill Economic Development Corporation and the Mauch Chunk Trust Company Community Advisory Board. He also serves as a co-facilitator of a Berks County Key Executive Peer Group for The S. Dale High Center for Family Business. Mike is the son of two public school music teachers. He resides in Lebanon with his wife, Irene, two daughters, Margot and Lillian, and son, Benjamin.

John M. Quain, Jr.

J. is a member of Barley Snyder’s Litigation Practice Group. Since joining Barley Snyder, J. has broadened his practice, assisting clients with matters pertaining to breach of contract, real estate, landlord and tenant litigation. He is also a member of the firm’s Creditors’ Rights Practice Group, where he handles bankruptcy and debt collection. J. has worked with contractors, corporate landlords and leasing companies on their collection efforts and has asserted the priority of mortgages and liens. He also deals with real estate litigation, ejectments and evictions.

J. has previous experience working as the lead litigator at the Pennsylvania Department of Community and Economic Development (DCED) as part of the Office of General Counsel within the governor’s office. He was able to successfully recover an excess of $15 million taxpayer dollars through judgments, bankruptcy and settlement agreements. He once served as counsel to the coordinator for the City of Harrisburg through the city’s progression toward financial recovery through the DCED. J’s experience handling administrative appeals comes from a familiarity with procedures and government appeals from administrative agencies. Additionally, J. has made appellate decisions in the Commonwealth Court and Superior Court of Pennsylvania.

Prior to his experience in Pennsylvania, J. served as a law clerk to the Hon. Michael J. Kassel in the New Jersey Superior Court. A Harrisburg native, J. is very active in the Dauphin County community and currently lives in Lancaster with his wife, Christina and their daughter. Outside of the firm, J. is active with the Dauphin County Bar Association’s Young Lawyers Division as treasurer of the organization.

Reilly S. Noetzel

Reilly is a member of the firm’s Real Estate Practice Group and the Construction, Environment, Land Use, and Municipal industry groups in addition to being a licensed title agent. He dedicates his practice to the representation of clients in all aspects of their real estate transactions and developments with a particular focus on condominium and planned community law, land use and development, construction and regulatory matters as well as leasing.  

Condominium & Planned Community Law 
As a large part of his practice, Reilly helps clients navigate the Pennsylvania Planned Community and Condominium Acts, and provides creative and efficient advice on structuring these types of developments.  He is familiar with the requirements of the Acts, and establishes the framework for each community to facilitate a smooth transition of the development at turnover.  Reilly recognizes this area of the law can be complex and routinely gives educational presentations to homebuilders, developers, and other professionals on condominium and planned community law compliance.  He has prepared and reviewed homeowners’ association and condominium documents for developments of all types and sizes, including building conversions, shopping centers, residential planned communities, master-planned developments, and site condominiums.  He also advises developers in completing lot takedowns within these types of communities.

Land Use & Development
Reilly’s zoning and land development work includes representation of clients in the submissions of and hearings for text amendment, rezoning, variance, special exception, conditional use, land development and condition modification applications. He understands the complexities of the Municipalities Planning Code and the requirements that municipalities and developers must follow throughout the land development process in Pennsylvania. Reilly’s experience in this area includes assistance with the development of mixed-use, commercial/industrial buildings and complexes as well as residential neighborhoods. 

Construction
In his construction practice, Reilly advises owners, contractors, subcontractors and design professionals on all facets of construction law and procurement matters, with a particular focus on negotiating contracts for uniquely funded projects, such as RACP and ARPA, as well as other state and private grant programs. This includes the review and negotiation of the American Institute for Architects (AIA) form agreements, updates to form purchase orders and agreements, and assistance with mechanics’ liens, prevailing wage, and Contractor and Subcontractor Payment Act issues. Reilly also has specific experience with engineering, procurement and construction (EPC) contracts for renewable energy projects. In addition, Reilly represents developers with respect to building code and Uniform Commercial Code (UCC) enforcement issues and appeals as well as Historic Architectural Review Board (HARB) approvals.  

Regulatory & Permitting
In connection with his land use and development practice, Reilly helps clients navigate the regulatory and permitting requirements associated with real estate projects including the rules and regulations of various Pennsylvania state agencies such as the Department of Environmental Protection, PennDOT, the Pennsylvania Liquor Control Board and the Pennsylvania Utility Commission. He regularly assists clients with issues related to permits for public infrastructure as well as highway occupancy, NPDES, post-construction stormwater management and building permits.

Leasing
Reilly devotes a significant portion of his practice to the representation of landlords and tenants in various leasing matters. He frequently negotiates retail, industrial, office, and ground leases and advises clients on ancillary leasing issues such as financing and construction matters. Through his experience in lease negotiations, Reilly is well-versed in standard commercial leasing clauses in central Pennsylvania. He often guides clients through the process of understanding lease provisions, including complex CAM clauses. Reilly also assists clients in the negotiation of energy and utility leases, including solar farm and cell tower leases.

Reilly prides himself on providing practical advice and delivering efficient results for his clients. He especially enjoys the tangible nature of real estate law and appreciates the ability to see a project through from beginning to end. His well-rounded experience in the areas above allows him to be the point person for developers throughout all stages of their projects.

In his spare time, Reilly enjoys biking, hiking, reading, astronomy, Revolutionary and Civil War history, and spending time with his family outdoors.

  • Represented a regional funeral home in the acquisition and development, including permitting, land development, and zoning approvals, for a new, approximately 14,000-square-foot funeral home and crematory. 
  • Represented a farm equipment and machinery sales and repair business in the sale of its existing building, the acquisition of raw land, and the development of a multi-phased, 300,000 square foot vehicle retail, service, and repair center. Reilly’s work on this matter included obtaining conditional use, variance, and land development plan approvals for the new building as well as assistance in obtaining a PIDA loan to finance the development.
  • Counseled a large retailer in the development of a multi-phased, 250,000-square-foot manufacturing, office, and warehousing center, including navigation of permitting and land development issues, sewer and water capacity matters, and special exception approvals for the use.
  • Represented landowners in obtaining variances and special exception approvals to convert existing buildings into an apartment building and an Airbnb building.
  • Represented a large church in the conversion of its existing building into a condominium, and the sale of a condominium unit to a buyer.
  • Counseled a residential developer in rezoning several tracts of land, obtaining text amendments for higher density, and development of townhome, single-family and mixed-use buildings.
  • Served as counsel for a one-of-a-kind stream restoration and walking trail project in Lancaster County, which included preparation of easements, construction documents, and municipal intergovernmental agreements related to stormwater and MS4 permitting.  
  • Served as landlord’s counsel on various lease negotiations for a new retail shopping center, which included advising the client on sophisticated CAM, exclusive use, and other specific retail leasing issues.
  • Obtained text amendment and conditional use approvals for a large-scale multifamily and townhome development in Lebanon County, and advised the developer on planned community structuring issues for the community.
  • Prepared condominium/planned community documents for a shopping center redevelopment, single-family and townhome developments throughout central Pennsylvania as well as building conversions in urban settings including Lancaster and Harrisburg.

Katelyn E. Rohrbaugh

Katelyn is no stranger to Barley Snyder. She comes to the firm after two previous part-time positions as a summer associate and law clerk while she finished her studies at the Drexel University Thomas R. Kline School of Law.

Barley Snyder hardly was the first experience in practical law for the West York native. She had worked as a legal assistant at a Philadelphia-area firm; a legal intern with the New Jersey Attorney General, State Police, Corrections & Employment Division working in employment litigation; a judicial intern with Judge Anne E. Lazarus of the Pennsylvania Superior Court and as a legal intern with the Pennsylvania Board of Pardons.

Katelyn recently has worked with companies in the rigorous process of receiving certification as a Women’s Business Enterprise (WBE). Businesses that are owned, managed and controlled by a woman, or women, are eligible to apply for the prestigious certification awarded by the Women’s Business Enterprise National Council.

At Drexel Law, Katelyn was the vice president of the school’s student bar association and was the articles editor at the Drexel Law Review. She attended Drexel Law on the Rising Advocate Scholarship, which covered her full tuition, and graduated magna cum laude. She also donated pro bono assistance to the Homeless Advocacy Project and the Pennsylvania Innocence Project, and was also a student mentor. 

She graduated summa cum laude from West Chester University, where she was the captain of the school’s cheerleading team and received a degree in psychology with a minor in criminal justice. Katelyn enjoys hitting the gym, spending time with her family and baking.

Erica R. Townes

Erica is an associate attorney in the Real Estate and Business practice groups. In her real estate practice, Erica assists clients in residential and commercial development, property acquisition, commercial lease negotiations, zoning, and land use concerns. Erica also devotes a substantial portion of her practice to representing businesses of all sizes and sophistication across a variety of industries. Erica’s practice ranges from assisting start-up companies with entity formation and governing documents, to working with more seasoned companies on complex mergers and acquisitions and succession planning. In both facets, Erica focuses on the structure, negotiation, strategic planning, and execution of business and real estate transactions.

To complement her corporate law practice, Erica has also worked with companies to obtain certification as a Women’s Business Enterprise (WBE). Businesses that are at least 51 percent owned, managed and controlled by a woman or women are eligible to apply for the certification awarded by the Women’s Business Enterprise National Council (WBENC). As a WBENC-Certified WBE, business owners have access to exclusive programs and resources designed to help their business grow and thrive, which includes access to supplier, and diversity and procurement executives at corporations, federal, state, and local government entities that accept WBENC Certification.

When not practicing law, Erica’s firm responsibilities include serving as a member of the firm’s Hiring Committee, where she is involved in recruiting for the firm’s Summer Associate Program, and serving on the firm’s Diversity Committee. Erica is also actively involved in the community and currently serves on the board of and is involved with a number of local nonprofit and professional organizations, including the York County Bar Foundation Board of Directors, the DreamWrights Center for Community Arts Board of Directors, the Community Progress Council Board of Directors, and the Family First Health Human Resources Committee.

Prior to joining Barley Snyder, Erica represented public and private employers in a variety of labor and employment law matters. As a law student, Erica also externed for the Supreme Court of Pennsylvania and Commonwealth Court of Pennsylvania for the Hon. P. Kevin Brobson.

While not a performer herself, Erica is a musical theatre enthusiast and frequently patronizes New York City and central Pennsylvania theatre productions. Her favorite show running on Broadway is “Hamilton.”

Eric M. Ondo

Eric is a member of the firm’s Business, Mergers & Acquisitions and Real Estate groups. 

In his business practice, Eric advises clients on all aspects of their business, ranging from entity selection and formation to succession planning. He counsels private entities — including closely held and family-owned businesses — on mergers, acquisitions, corporate governance and a variety of other transactional matters. He also frequently assists clients with general business issues including contract drafting, review and negotiation. Furthermore, Eric has experience with handling formations for nonprofit organizations. 

A substantial portion of Eric’s practice is assisting clients with mergers and acquisitions, including stock and asset transactions. In this role, he conducts due diligence, structures transactions, negotiates and drafts letters of intent, negotiates and drafts acquisition agreements, reviews non-compete and non-disclosure agreements in addition to other matters. Eric enjoys helping his clients navigate the complex process of M&A transactions, ultimately helping to bring the deal to a success close. 

Eric’s real estate practice dovetails with his business practice where he handles matters relating to residential and commercial agreements of sale, leases, restrictive covenants, easements as well as navigating various zoning and land-use issues.

Eric started at Barley Snyder as summer associate and continues a long-time tradition of joining the firm later as an attorney. During law school, Eric practiced as a certified legal intern at the Penn State Family Law Clinic, gaining valuable experience working directly with clients. He also donated pro bono services drafting trusts and estates documents for senior citizens in Centre County. In addition, Eric worked as an intern with the Pennsylvania Office of General Counsel, aiding the Pennsylvania Department of State’s Bureau of Professional and Occupational Affairs in 2018. Before moving into law, Eric worked in investment performance in the Washington, D.C. area. He also was a Congressional intern in the U.S. House of Representatives. His wide range of experiences have aided Eric in bringing a thoughtful, considered approach to the unique circumstances and goals of his clients.

A Lebanon County native, Eric now lives in Lancaster County and is a former Eagle Scout. He played four years of football at Dickinson College, where he graduated cum laude, and is also a cum laude graduate of Penn State Law. Eric is proud to be a member of Leadership Lancaster Core Class of 2024 and values community service and involvement. In his time away from the office, Eric enjoys spending time with his wife and son, golfing and Penn State football.
